Nothing upfront — ever. We work on a contingency fee basis, which means we only get paid a percentage of what we recover for you. If we don't recover compensation for you, you owe us absolutely nothing. We also advance all costs to pursue your claim, so there's no financial risk to you. This is how we're able to fight for every client, regardless of their financial situation.
You may still be able to recover compensation — but Texas law has a critical rule you need to know. Texas follows modified comparative fault with a 51% bar (Tex. Civ. Prac. & Rem. Code §33.001). This means:
  • If you were 50% or less at fault, you can still recover — your award is simply reduced by your percentage of fault.
  • If you were 51% or more at fault, you are barred from recovering anything.
For example: if your damages are $100,000 and you were 30% at fault, you can still recover $70,000. Insurance companies will try to push your fault percentage above 50% to deny your claim entirely. Our job is to prevent that.
In Texas, the standard statute of limitations is 2 years from the date of your accident (Tex. Civ. Prac. & Rem. Code §16.003). However, important exceptions apply:
  • Government entities (TxDOT, city vehicles, government property): You must file a formal notice of claim within 6 months under the Texas Tort Claims Act. Missing this is fatal to your case.
  • Minors: The statute of limitations is tolled (paused) until the minor turns 18.
  • Wrongful death: 2 years from the date of death, not necessarily the accident.

Once you sign a release, you permanently waive your right to seek additional compensation in Texas, even if your injuries turn out to be far more serious than expected.
